These Terms of Use ("Terms") govern your access to and use of myzer.co (the "Site") and the services provided by Myzer LLC ("Myzer," "we," "us," or "our") (the "Services"). Please read them carefully. By accessing or using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. About Myzer and our role

Myzer operates a home renovation marketplace that connects homeowners with independent construction and renovation professionals ("Pros"), and provides website and online presence services to construction businesses.

Myzer is a marketplace and advisory platform. Myzer is not a contractor, builder, home improvement company, or licensed construction professional, and we do not perform construction, renovation, or repair work. We are not a party to any agreement, contract, or transaction between a homeowner and a Pro. Any work performed by a Pro is performed solely by that Pro, and the agreement for that work is solely between the homeowner and the Pro.

2. Eligibility

You must be at least 18 years old to use the Site or Services. By using the Site or Services, you represent that you are 18 or older and able to enter into a binding agreement.

3. Homeowner responsibilities and quotes

Myzer can help you find Pros, request quotes, and compare options. However:

• Myzer does not guarantee that you will receive quotes, that any Pro will be available, or that any project will be completed.
• Myzer does not guarantee the quality, safety, legality, timeliness, or outcome of any work performed by a Pro.
• You are responsible for independently evaluating, vetting, and selecting any Pro, including verifying their licensing, insurance, references, and qualifications.
• Any contract for work is directly between you and the Pro. You are responsible for the terms of that contract, including price, scope, and timeline.

You agree that Myzer is not responsible or liable for the acts, omissions, work, conduct, or agreements of any Pro.

4. Information for construction businesses and Pros

If you use Myzer for lead generation, website services, or online presence services, additional terms may apply, including a separate service agreement that governs scope, pricing, ownership, timelines, and revisions. You are responsible for the accuracy of the business information, licensing information, and content you provide, and for ensuring you have the rights to any materials you submit.

5. User submissions and content

When you submit content to the Site or Services (such as project details, photos, business information, logos, text, or other materials), you keep ownership of your content. You grant Myzer a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, display, and share that content as needed to operate and provide the Services (for example, sharing a homeowner's project details with Pros, or building a business client's website).

You represent that you own or have the necessary rights to the content you submit, and that your content does not violate any law or the rights of any third party. You are responsible for your content.

6. Acceptable use

You agree not to:

• Use the Site or Services for any unlawful, fraudulent, or harmful purpose.
• Submit false, misleading, or inaccurate information.
• Infringe the intellectual property or privacy rights of others.
• Upload viruses, malicious code, or attempt to disrupt or gain unauthorized access to the Site or Services.
• Scrape, harvest, or collect information about other users without authorization.
• Use the Services to send spam or unauthorized advertising.

7. Fees and payments

Some Services involve fees, such as service fees for homeowners, website build fees, and recurring maintenance plans for business clients. Applicable fees and billing terms will be disclosed to you before you incur them. Payments are processed by third-party processors such as QuickBooks, Stripe, or Square. You agree to pay all fees you incur.

8. Intellectual property

The Site and Services, including the Myzer name, logo, design, text, and other content created by Myzer, are owned by Myzer or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our permission, except for content you submit or content we deliver to you under a separate service agreement.

9. Third-party links and services

The Site may contain links to or integrations with third-party websites and services, including Pro websites and Google reviews. We do not control and are not responsible for third-party sites or services, and your use of them is at your own risk and subject to their terms.

10. Disclaimers

The Site and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Myzer does not warrant that the Site or Services will be uninterrupted, error-free, or secure, or that any Pro or work will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, Myzer and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or Services, the conduct or work of any Pro, or any agreement between a homeowner and a Pro. To the fullest extent permitted by law, Myzer's total liability for any claim arising out of or relating to the Site or Services will not exceed the greater of the amount you paid to Myzer in the three months before the claim, or one hundred dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Myzer and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Services, your content, your violation of these Terms, or your dealings with any Pro or homeowner.

13. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Provisions that by their nature should survive termination will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Nevada, and you consent to their jurisdiction. (Myzer may update the governing jurisdiction if its principal place of business changes.)

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page. Your continued use of the Site or Services after changes take effect means you accept the updated Terms.
